Terms of Use
Last Updated:
These Terms of Use apply to the Waylo Ahead app, website and related services. In these Terms, the service may also be referred to as Waylo.
Waylo Ahead is a registered business name of Naked Rivals Pty Ltd (ABN 72 665 070 477), an Australian company and the legal entity that operates the service (we, us, our).
By creating an account, purchasing a subscription or using Waylo, you agree to these Terms. If you are using Waylo on behalf of a learner driver who is under the age at which they can enter a binding contract in their jurisdiction, the account must be created or managed by a parent, guardian or other adult who is legally responsible for that use.
1. What Waylo does
Waylo is a learner-driving experience tool. It can help users:
record supervised driving experience;
see the types of roads, conditions, traffic environments and situations a learner has experienced;
identify gaps in that experience;
suggest practice routes or opportunities intended to broaden experience; and
provide optional coaching feedback based on in-car conversation and other drive information.
Waylo is designed to complement professional driving instruction. It is not a driving school, driving instructor, licensing authority, official logbook, emergency service or guarantee of driving competence.
Waylo does not certify that a learner is safe, competent, test-ready or ready to drive independently.
2. Driving safety comes first
Driving safely and lawfully is always more important than following Waylo.
Before a drive, the learner and supervising driver are responsible for confirming that:
the learner is legally entitled to drive;
the supervising driver is legally entitled to supervise;
the vehicle satisfies applicable learner-driver and insurance requirements;
the proposed roads and route are lawful for that learner and supervision arrangement;
any time-of-day, passenger, speed, road-class, weather or other restrictions are satisfied; and
current road, traffic and weather conditions make the drive appropriate.
The learner driver and supervising driver must not handle or manually interact with a phone or Waylo while the vehicle is moving or while doing so would be unsafe or unlawful. Configure Waylo before the drive. If interaction is required, stop and park somewhere lawful and safe first.
Road signs, police directions, traffic controls, licence conditions and applicable law always override anything shown or suggested by Waylo.
If a suggested route appears unsafe, unsuitable or unlawful, do not follow it.
3. Suggested routes and jurisdiction-aware safeguards
Waylo may use country, state, province or other jurisdiction-specific rules to reduce the chance of suggesting roads or situations that are not appropriate for a learner.
These safeguards are an additional safety feature. They are not a legal determination, warranty or guarantee that every suggested route is lawful or suitable.
Driving laws and licence conditions can change. They can also depend on facts Waylo may not know, including the learner's permit or licence type, age, supervision arrangement, vehicle, passenger restrictions, time of day, local road classifications, temporary restrictions and special conditions.
You must independently confirm the legal and practical suitability of a route before and during the drive.
4. Maps, roads and changing conditions
Waylo relies partly on maps, routing systems, location services and other data supplied by third parties.
Map and routing information can be incomplete, delayed or wrong. Roads can close or change. Temporary restrictions, construction, weather, traffic, private-road restrictions, signage, speed limits and hazards may not be reflected accurately or immediately.
Waylo does not guarantee that a suggested road or route is open, accessible, lawful for a particular learner, free from hazards or appropriate for current conditions.
Always use your own judgement and follow current signs, restrictions and lawful directions.
5. Professional instruction and supervision
Professional instructors remain responsible for teaching driving skills, technique and judgement.
A supervising driver remains responsible for deciding whether a particular supervised drive is appropriate and for carrying out their legal responsibilities as a supervisor.
Waylo is intended to help broaden experience. It must not be used as a substitute for professional instruction, competent supervision, licensing rules or road-safety obligations.
6. Conversation Feedback and AI-generated content
Conversation Feedback is an optional coaching aid. It may use recognised in-car conversation and drive information to generate feedback about communication, timing, clarity, distraction and similar themes.
AI-generated or automated feedback can be incomplete, inaccurate, inappropriate or wrong. It is not professional driving instruction, a safety assessment, a medical or psychological assessment, or a determination that a person is safe or unsafe to drive.
Do not rely on Conversation Feedback or any other Waylo output for an immediate safety-critical decision.
7. Accounts and learner profiles
You must provide accurate information and keep your account secure.
Where an adult creates, manages or contributes information about a learner, that adult must have appropriate authority to do so.
Do not create a learner profile for a person if you do not have authority to provide the information required for that profile.
You are responsible for activity carried out through your account unless caused by our failure to take reasonable security measures.
8. Subscriptions and free trials
Where Waylo offers a paid subscription through the Apple App Store or another authorised platform, the price, renewal period, free-trial terms and cancellation method shown by that platform at the time of purchase form part of the purchase terms.
Unless the relevant platform states otherwise, subscriptions renew automatically until cancelled.
Deleting a Waylo account does not necessarily cancel a subscription purchased through a third-party app store. You must manage that subscription through the relevant platform.
Nothing in this section limits any refund, cancellation or consumer rights that apply under mandatory law.
9. Third-party services
Waylo may depend on third-party services including app stores, mapping and routing providers, cloud hosting, authentication, analytics, communications and AI-processing providers.
We are not responsible for a third-party service merely because Waylo connects to or relies on it. Your use of some third-party services may also be subject to their own terms.
10. Intellectual property
Waylo, its software, branding, content, product design and related intellectual property are owned by or licensed to Naked Rivals Pty Ltd.
You may use Waylo only for its intended personal or authorised professional purpose. You must not copy, reverse engineer, resell, scrape, reproduce or commercially exploit Waylo except where the law allows it or we have given written permission.
11. Service availability and changes
We may add, change, suspend or discontinue features as Waylo develops.
We aim to provide a reliable service, but we do not promise that Waylo will always be available, uninterrupted, secure or error-free.
We may suspend access where reasonably necessary for security, maintenance, legal compliance, suspected misuse or protection of users.
12. Consumer rights and warranties
Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
Depending on where you live, mandatory consumer-protection laws may give you rights in addition to these Terms. Those rights continue to apply.
Except for rights and warranties that cannot lawfully be excluded, Waylo is provided on an as available basis. To the maximum extent permitted by law, we do not give additional warranties that Waylo, its route suggestions, classifications, recommendations, feedback or third-party information will always be accurate, complete, current, suitable or error-free.
13. Limitation of liability
This section applies only to the maximum extent permitted by applicable law.
We do not exclude or limit liability where the law does not allow us to do so, including any liability for death or personal injury caused by negligence where such liability cannot lawfully be excluded or limited, or any mandatory consumer guarantee or statutory right.
Subject to those non-excludable rights, Naked Rivals Pty Ltd is not liable for loss or damage to the extent it is caused by:
a learner, supervisor or other user failing to comply with applicable road or licensing laws;
following a route despite a road sign, restriction, condition or lawful direction indicating that it should not be followed;
an unsafe or unlawful driving decision made by a learner or supervising driver;
use of or interaction with Waylo while driving in an unsafe or unlawful manner;
inaccurate, delayed or incomplete maps, routing, road, traffic, weather, device, GPS or other third-party information;
a change in law, licence condition, road classification or temporary restriction not yet reflected in Waylo;
information supplied incorrectly or incompletely by a user;
failure of a device, mobile network, GPS service, operating system or third-party service; or
use of Waylo for a purpose for which it is not designed.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profit, loss of revenue, loss of opportunity or business loss arising from personal use of Waylo.
For any liability that may lawfully be limited but not excluded, our aggregate liability arising out of or relating to Waylo will not exceed the greater of:
the amount you paid to us for Waylo in the 12 months before the event giving rise to the claim; and
AUD $100.
This monetary cap does not apply where applicable law prohibits that limitation.
14. Your responsibility for lawful use
You must not use Waylo in a way that is unlawful, unsafe, fraudulent, abusive or likely to interfere with the service or another person.
You remain responsible for complying with the laws and licence conditions that apply to you, the learner, the supervisor, the vehicle and the place where a drive occurs.
15. Privacy
Our handling of personal information is described in the Waylo Privacy Policy.
Where a learner is a minor, additional privacy notices or consent steps may apply.
16. Ending your use of Waylo
You may stop using Waylo at any time and may request account deletion through the app where that feature is available.
We may suspend or terminate access where reasonably necessary because of material breach of these Terms, fraud, security risk, legal requirements or serious misuse.
Termination does not affect rights or liabilities that arose before termination.
17. Changes to these Terms
We may update these Terms when Waylo, applicable law or our business changes.
If a change materially affects your rights, we will take reasonable steps to notify you before or when it takes effect where required by law.
The current version will be published on the Waylo Ahead website with its effective date.
18. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia.
The courts of New South Wales have non-exclusive jurisdiction over disputes relating to these Terms.
This governing-law clause does not deprive you of any mandatory consumer protection or right to bring a claim in another forum that applies under the law of the country, state, province or territory in which you live.
If you have a concern, we encourage you to contact us first so we can try to resolve it promptly. This does not limit your right to contact a regulator, tribunal, court or consumer-protection body.
